Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Trading Hearts Productions LLC, a Florida limited liability company (“Trading Hearts,” “we,” “us,” or “our”). They govern your use of tradinghearts.com, Trading Hearts México, tradinghearts.productions, our membership, and our content-publishing tools (together, the “Service”). Our Privacy Policy, Cookie Notice and Refund & Cancellation Policy form part of these Terms.

1. The Service

Trading Hearts is an entertainment and educational universe of original, character-led stories, comics, videos, books and history, including a paid membership. We also offer tools for creating content and publishing it to social accounts you connect.

2. Fiction, Education and No Financial Advice

• Fiction. Trading Hearts is a fictional universe inspired by real markets, events and history. Its characters, relationships and dialogue are invented or dramatized. Any resemblance of a fictional character to a real person, living or dead, is coincidental unless that person is expressly identified as a historical figure. Historical figures and events are depicted in dramatized form.
• Not financial advice. Nothing in the Service is investment, financial, trading, tax, legal or political advice, nor a recommendation or offer to buy or sell any security, currency, commodity or other instrument. Market data, prices and events referenced in our stories may be delayed, simplified or dramatized and must not be relied on for any decision. Consult a licensed professional before making financial decisions.

3. AI-Generated and AI-Assisted Content

We use artificial-intelligence tools to help create, voice, animate and illustrate much of our content. Images, video, voices and characters may be wholly or partly AI-generated. Characters who look or sound realistic are synthetic unless we state otherwise. We label AI-generated content where the law or a platform’s rules require it.

4. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use the Service for an organization, you confirm you have authority to bind it to these Terms.

5. Accounts and Security

You may sign in with a one-time email link, Google or Facebook. Keep access to your email and sign-in accounts secure. You are responsible for activity under your account, and you must tell us promptly about any unauthorized use. Memberships are personal: do not share your access or member content. We may suspend accounts that violate these Terms or threaten the Service.

6. Membership, Billing and Automatic Renewal

• Payments. PayPal processes payments under its own terms. You authorize recurring charges when you subscribe.
• Price changes. We will email you at least 30 days before any price change takes effect. You can cancel before the change. If you do not cancel, the new price applies from your next renewal.
• Reminders. We will send any renewal notices the law requires, including for free trials or promotional prices that convert to paid plans, if we ever offer them.
• Refunds are governed by our Refund & Cancellation Policy.
• Content changes. Member content changes over time. We may add, change or remove titles or features, but we will not materially reduce what a paid period includes without notice.

7. Your Content

You own the content you lawfully create or upload using our tools (“Your Content”). You give us a non-exclusive, worldwide, royalty-free license to host, store, process, display and publish Your Content only as needed to provide the Service and carry out the publishing actions you approve. You confirm that you have all rights needed for Your Content and that it does not infringe anyone’s rights or break the law.

8. Our Intellectual Property

The Service and its content are owned by Trading Hearts Productions LLC or its licensors and are protected by copyright, trademark and other laws. This includes the Trading Hearts name and logos, the Custodian characters, the Saga books, the comics, the films, the music and the artwork. We grant you a limited, personal, non-transferable, revocable license to view and use the Service for personal, non-commercial purposes. You may not copy, download (except where we offer a download), redistribute, scrape, adapt, or use our content or characters to train AI models without our prior written consent. Sharing our public links and short quotations with attribution is welcome.

9. Acceptable Use

You may not:

• break the law, infringe others’ rights, or post deceptive or harmful material;
• bypass paywalls, access controls or security measures;
• scrape, crawl or bulk-download the Service;
• reverse engineer, overload or disrupt the Service;
• impersonate anyone or misrepresent your affiliation with Trading Hearts;
• violate the rules of any connected third-party platform.

10. Copyright Complaints (DMCA)

If you believe material on the Service infringes your copyright, send our designated agent a notice under 17 U.S.C. § 512(c). The notice must include:

1. your physical or electronic signature;
2. identification of the copyrighted work;
3. identification of the infringing material and where it is on the Service;
4. your contact information;
5. a statement of your good-faith belief that the use is not authorized;
6. a statement, under penalty of perjury, that the notice is accurate and that you are the owner or are authorized to act for the owner.

We may remove material and terminate repeat infringers. Counter-notices may be sent to the same agent under § 512(g).

11. Third-Party Services

The Service connects to third-party services (including PayPal, Google/YouTube, Meta, TikTok, X, LinkedIn, Supabase, Cloudflare and Amazon). They are governed by their own terms, and we are not responsible for them.

12. Electronic Communications

You agree to receive sign-in links, receipts, renewal and price notices, and other service messages electronically at your account email. Electronic notices satisfy any legal requirement for written communication.

13. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, Trading Hearts and its members, managers, employees and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, trading or investment losses, data or goodwill, arising from or relating to the Service. Our total liability for any claim will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim arose or (b) US$100.

Some jurisdictions do not allow these limits. Where they do not, the limits apply only to the extent permitted, and nothing in these Terms limits rights that cannot be waived under applicable consumer law.

15. Indemnification

You will defend, indemnify and hold harmless Trading Hearts against any claims, losses and expenses (including reasonable attorneys’ fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or of others’ rights.

16. Dispute Resolution; Arbitration; Class-Action Waiver

• Informal resolution first. Before filing a claim, email support@tradinghearts.com with a description of the dispute. We will both try in good faith to resolve it within 60 days.
• Binding arbitration. If the dispute is not resolved, it will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration may be conducted by video or in your county of residence. We will pay the filing, administrative and arbitrator fees the AAA rules assign to businesses.
• Exceptions. Either party may bring an individual claim in small-claims court, or seek injunctive relief in court for infringement or misuse of intellectual property.
• Class-action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding.
• Opt-out. You may opt out of this Section 16 by emailing support@tradinghearts.com within 30 days after you first accept these Terms, with the subject “Arbitration opt-out.”
• Where the law of your country of residence does not permit this section, it does not apply to you.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 16, the state and federal courts located in Orange County, Florida have exclusive jurisdiction. If you are a consumer residing outside the United States, you keep the protection of any mandatory provisions of the law of your country of residence.

18. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to protect the Service or others. Sections 2, 3, 7, 8 and 13–20 survive termination.

19. Changes to These Terms

We will post updates at this URL with a new date and version. For material changes, we will notify members by email or on the site at least 15 days before they take effect, and we may ask you to accept the new version. Changes do not apply retroactively to disputes we already know about.

20. General

These Terms are the entire agreement between you and us about the Service.

• If any provision is unenforceable, the rest remains in effect.
• Our failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent. We may assign them in connection with a merger, financing or sale of assets.
• If we publish a translation of these Terms, the English version controls, except where local law requires otherwise.
